Residential Development

Securing the land and the planning consent is only the start when it comes to residential development.

A development has to be set up properly and it must be future-proofed. Agreements or private arrangements need to be put in place for the roads and sewers, the planning obligations met, and the long-term arrangements put in place so the site runs smoothly long after you’ve moved on. It’s detailed, deadline-driven work, and getting it wrong can hold up an entire scheme.

Affordable housing

One of the first hurdles is often the affordable housing obligations. With experience acting for both developers and housing associations, we can either sell the affordable units on your behalf or act on their purchase, whichever your scheme needs.

Planning and infrastructure agreements

Much of the early work is putting the planning and infrastructure agreements in place so the planning obligations are agreed, consent is granted, essential services are maintained, via adoption or privately. Our services include (but are not limited to):

  • Section 106 Agreements and Unilateral Undertakings
  • Section 104 or 185 agreements and Deeds of Grant with the water authority/NAV
  • Section 278 and 38 agreements with the highways authority

Transfers as the site is built out

We deal with these alongside the transfers that crop up as a site is built out, from handing the substation to the electricity company and the fibre network to its provider, to passing open space to the council or a management company at the right time.

Setting up for the long term

We also help you set the development up for the long term. That means advising on how it should be managed once complete, drafting the management company agreements where appropriate and, if needed, working with our corporate team to establish a residents’ management company so that when you finish and step away from the development everything is in order and properly looked after.

Where there are flats, we make sure your statutory duties are met, including the obligations around transferring the freehold to the management company at the right stage. The aim is a development that’s clean, compliant and ready to run itself.
