Lowestoft working harbour with commercial premises and fishing fleet — commercial landlord and tenant solicitors

Commercial Landlord & Tenant

Whether acquiring or granting a commercial lease, the terms agreed will have significant legal and commercial implications for years to come.

Rent review provisions, repairing obligations, alienation rights, security of tenure and termination provisions all require careful consideration to ensure the arrangement reflects your commercial objectives and appropriately manages risk. We act for both landlords and tenants, providing balanced, commercially focused advice informed by an understanding of the priorities and negotiating positions on both sides of the transaction.

For landlords & tenants

For landlords, we advise on the grant of new leases, lease renewals, assignments, underlettings, licences to assign, licences for alterations, and lease terminations. For tenants, we provide strategic advice throughout the lifecycle of a lease, from negotiating the terms of a new letting through to obtaining landlord’s consents and advising on assignments, underlettings and lease renewals. We also advise on deeds of variation where commercial arrangements evolve and prepare options to renew and reversionary leases to provide long-term certainty where appropriate.

Early advice on heads of terms

We encourage clients to involve us at the earliest opportunity, ideally when heads of terms are being negotiated. Early legal input allows key commercial and legal issues to be identified before positions become fixed, helping to avoid unnecessary risk, preserve negotiating flexibility and ensure the final documentation accurately reflects the agreed commercial intent.

If a matter turns contentious

Whilst many landlord and tenant matters proceed without difficulty, disputes can arise during the term of a lease or at its conclusion. Whether involving contested lease renewals or terminations, dilapidations, breaches of covenant or the service and validity of statutory notices, our specialist Property Litigation team provides expert advice to both landlords and tenants. Working closely with our transactional lawyers, they ensure continuity of advice should a matter become contentious, allowing clients to benefit from a seamless service throughout.
